Ha másik eu-s országból indítanak ellenem behajtást, úgy hogy a nevem, születési időm, email címem, telefonszámom és talán az ottani volt ideiglenes lakóhelyem tudják csak, akkor annak lehet bármilyen következménye rám nézve?

Lengyelországban voltam, és egy koditeremnél volt egy olyan akció hogy 14 napig ingyenes, viszont ha nem mondod le, akkor automatikusan 1 év hűséggel fizetheted a havi kb 10.000 Ft-ot. A regisztrációkor meg kellett adni bankkártya adatokat, és így elvileg autómatikusan vonta volna minden hónapban, 1 PLN a 14 napért és utána a rendes összeg kb 120 PLN havonta.

Én a 14. napon próbáltam lemondani, és nem engedte a rendszer, de mivel a kártyámról nem vonta le a pénz, gondoltam jó, és annyiban hagytam.

Ez februárban volt, amikor vissza is jöttem Magyarországra, tehát nem használtam jogtalanul a konditermet.

És most véletlenül láttam, hogy egy lengyel nyelvű emailt küldtek, amit kiváncsiságból lefordítottam, és abban volt ez a fizetési felszólítás és bírósággal fenyegetés.

Aztán rákerestem az emaileknél, és láttam, hogy ez a 4. volt már.

Az email amúgy sem tekinthető hivatalos tájékoztatásnak, vagy nem jól tudom? Ráadásul lengyel nyelven. Tökvéletlenül vettem ezt is észre.

A volt lengyel címemre küldtek egy lengyel nyelvű levelet, de mivel február óta Magyarországon vagyok ezt nem tudtam.

Kis kutakodás után láttam, hogy lengyeleknek is voltak hasonló problémáik.

Egyikőjük érvelése, lengyelről angolra fordítva:

Unfortunately, recently, there have been many attempts on your part to force me to pay funds for an Agreement that has not been concluded.

In accordance with the Offer Regulations:

§ 2, point 3.: "(..) The operator issues an invoice to the User in electronic form (...)" - I have not recorded any invoice that would indicate that the Agreement was concluded, or confirmation that the verification fee was successfully booked ;

§ 2., point 4: "Payment of the Verification Fee (...) is one of the conditions necessary to conclude the Agreement (...)" - the verification fee has not been paid, about which you have informed me many times in e-mails, which are attached to my complaint. Due to failure to meet ONE OF THE NECESSARY CONDITIONS, i.e. the lack of a verification fee, THE AGREEMENT HAS NOT BEEN CONCLUDED;

§ 2., point 12: "The card may be issued to the User after verification of the User's identity with the ID card and the order ID received in the e-mail from the Operator (...)" - no order confirmation has been recorded in my e-mail box or its identifier;

What's more, despite your information on the failure to pay for the transaction, I did not make another attempt to pay, which results in the failure to conclude the Agreement, as stated in the provisions of your Regulations: § 3, point 3: "(...) Failure to pay the Verification Fee by The User will prevent the completion of the order and the conclusion of the Agreement (...) ".

§ 3, point 5: "The Card may only be issued to the User who concluded the Agreement." - the contract was not concluded, therefore I was not issued the card, so I did not use the Services for which you are now demanding money.

In view of the above arguments, it requests the cessation of the attempts to extort funds in the amount of PLN 463.05, as the Agreement has NOT been concluded.

In addition, I am asking you to stop processing personal data and transferring them to third parties, because I have no obligations to you. At the same time, I request the deletion of all data in your databases and other cooperating entities and withdraw all consents to their processing.

It obliges the Data Administrator to provide information to whom the personal data was provided and the reason for unlawful transfer of it.

As agreed with the Municipal Consumer Ombudsman in the Capital City of Warsaw, I would like to inform you about submitting a complaint against your unlawful actions to this body"

Köszönöm a segítséget, felveszem velük a kapcsolatot, de ahogy láttam mások tapasztalatából, körülbelül 1 hónap mire válaszolnak, és akkor sem segítenek.

Viszont a [§ 2, point 3] és a [§ 2., point 4] releváns erre a helyzetre is szerintem, nem? vagyis az 1 PLN verifikációs díj nem ment el a kártyámról, tehát a szerződés semmis e szerint.
